1. Introduction

This Acceptable Use Policy (“AUP”) outlines the rules and standards for using the ClicData cloud platform. It applies to all modules, features, and services provided by ClicData, whether you are a paid customer or a trial user. ClicData is committed to high security and compliance standards (including ISO 27001 and SOC 2 certifications and adherence to data protection laws like GDPR), and we require that all users uphold these standards. By using the ClicData platform (“Service”), you agree to comply with this AUP. This Policy is designed to be clear and accessible, and it is incorporated by reference into ClicData’s Terms of Service. Please read it carefully. If you have any questions, contact us at contact@clicdata.com.

2. Scope

This AUP applies to everyone using ClicData, including individual trial users, paid customers, and any person or entity accessing the Service through a customer’s account. It covers use of all parts of the ClicData platform – for example, data integration tools, storage and data management features, dashboards and visualization modules, collaboration and sharing features, APIs, and any other functionality ClicData provides. The Policy applies regardless of how you access the Service (via web, mobile, API, or integration). All users are responsible for ensuring that their use of ClicData is in line with this AUP, our Terms, and applicable laws and regulations.

3. Acceptable Use Guidelines

We encourage you to use ClicData in productive and lawful ways to get the most out of the platform. Acceptable use of ClicData includes, for example:

  • Uploading, connecting, and managing datasets that you own or are authorized to use for analysis.
  • Creating dashboards, reports, and data visualizations for your legitimate business or personal analytics needs.
  • Sharing insights and dashboards with colleagues or authorized users in a manner that respects privacy and confidentiality.
  • Integrating ClicData with approved third-party applications or APIs to facilitate your data workflow, in compliance with those services’ terms and this AUP.

In general, any use of ClicData that is legal, respectful, secure, and in line with the platform’s intended purposes is considered acceptable. The sections below describe unacceptable uses and behaviors that are prohibited on the platform.

4. Prohibited Conduct

You must not use ClicData (including any module, feature, or component of the Service) in any manner that is illegal, abusive, unethical, or that could harm ClicData, its users, or others.

Prohibited conduct includes, but is not limited to, the categories and examples below. These examples are provided for clarity and do not represent an exhaustive list of all unacceptable behavior. If you are unsure whether an action is allowed, err on the side of caution or contact ClicData for guidance.

4.1 Illegal or Harmful Activity

  • Illegal Purposes: Using the Service for any purpose or activity that violates any law or regulation. This includes, for example, using ClicData to engage in fraud, trafficking (human, drug, or otherwise), disseminating or storing child sexual abuse materials, or any other criminal activity.
  • Violation of Rights: Uploading, storing, or distributing data that violate others’ legal rights. For instance, do not use ClicData to invade someone’s privacy or to collect, process, or share personal data in a way that violates data protection laws (such as GDPR or HIPAA) or without proper authority/consent.
  • Harmful Content: Storing or sharing content that is defamatory, libelous, harassing, threatening, or that promotes violence or hate against individuals or groups. Any content that is obscene, vulgar, or otherwise offensive and likely to cause harm is strictly forbidden.
  • Dangerous Activities: Using the Service in a manner that could damage or endanger ClicData or any third party. For example, you may not use ClicData to facilitate the creation of weapons, to support terrorist organizations, or to transmit information that could be used for cyber-attacks.

4.2 Security Violations and System Abuse

  • Unauthorized Access: Attempting to gain unauthorized access to any part of the ClicData Service, accounts of other users, or any related systems or networks. This means no hacking, password mining, or circumventing access controls. You may only access the Service via the interfaces and credentials provided to you.
  • Penetration Testing/Scanning: Probing, scanning, or testing the vulnerability of the platform or associated networks without ClicData’s express written consent is prohibited. (If you believe you have discovered a security vulnerability, see the User Responsibilities and Reporting sections for how to notify us — do not attempt to exploit it.)
  • System Interference: Willfully interfering with or disrupting the integrity or performance of the Service or the data contained therein. You may not launch any form of denial-of-service (DoS) attack, distribute malware (viruses, worms, Trojan horses, spyware, or other malicious code), or engage in any activity that degrades the Service’s reliability or availability for other users.
  • Resource Abuse: Using the Service in a way that overburdens ClicData’s infrastructure or goes beyond intended use cases. For example, you must not run automated scripts or tools that send an excessive number of requests to our servers (outside of permitted API usage), or upload extremely large data sets in a manner that impairs system performance for others. Normal data uploads and API calls are fine – abusive volume or intensity is not. ClicData reserves the right to moderate or restrict excessive usage that threatens platform stability.
  • Avoiding Security Measures: Attempting to bypass or break any security mechanism in the Service. This includes evading file type restrictions, encryption, or filtering mechanisms that are in place to protect the platform. Reverse-engineering or disassembling any part of the Service to find vulnerabilities or to circumvent usage limits or filters is strictly forbidden.

4.3 Spam, Malicious, and Deceptive Practices

  • Unsolicited Communications (Spam): You may not use ClicData to send spam or mass, unsolicited communications. For example, do not use our email sharing features to send reports or invitations to people who have not agreed to receive them. Any emails, messages or invitations sent through the platform must comply with applicable anti-spam laws (such as CAN-SPAM, CASL, or equivalent) – this means no sending of bulk emails without consent, no misleading headers or subject lines, and including opt-out mechanisms as required.
  • Malware and Phishing: Do not upload or transmit any material containing harmful code (viruses, malware, ransomware, etc.) or use the platform in phishing schemes. You must not use ClicData to impersonate others in emails or messages or trick recipients into revealing sensitive information. Any attempt to deceive others (customers, ClicData users, the public) via the Service is prohibited.
  • Fraudulent Activity: Using ClicData in connection with fraudulent schemes or operations is forbidden. This includes activities like running pyramid schemes, using data analysis to facilitate fraud, or misrepresenting your identity or affiliation while using the platform.

4.4 Intellectual Property and Content Rights

  • Copyright or Trademark Infringement: You must not use ClicData to store, display, or distribute content that infringes intellectual property rights of others. This means do not upload content (data, text, images, code, etc.) that you do not have the legal right to use. For example, do not import a third party’s proprietary data or copyrighted material into ClicData without permission. Likewise, do not share or publish any content from ClicData in a way that violates someone else’s copyrights, trademarks, patents, or trade secrets.
  • Unauthorized Use of ClicData Materials: The ClicData platform and all associated software, designs, and content are protected by ClicData’s own intellectual property rights. You may not modify, copy, distribute, reverse engineer, or create derivative works based on the platform’s code or features (except to the extent allowed by law or expressly permitted by ClicData). Also, you may not use the Service to build or benchmark a competing product or service, nor use any confidential information or proprietary data from ClicData for competitive analysis.
  • Proper Licensing of Integrations: If you use third-party data sources or integrations with ClicData, ensure you comply with those third parties’ license terms. Using integrations to pull data into ClicData that you are not authorized to use is a violation of this AUP. You are responsible for having the rights to any data you bring into the platform.

4.5 Inappropriate Content and Communications

  • Offensive or Objectionable Material: Do not use ClicData to store or share content that is obscene, pornographic, or excessively graphic, or that a reasonable person would consider deeply offensive. Professional and respectful content should be the norm when using our platform.
  • Harassment and Hate: The Service must not be used to harass, bully, or stalk individuals. Any content or communications that incite hatred or violence against individuals or groups (on the basis of race, ethnicity, religion, gender, sexual orientation, etc.) are strictly prohibited.
  • Impersonation and Misrepresentation: You may not impersonate any person or organization or misrepresent your identity or affiliation when using ClicData. For example, do not pretend to be another user, a ClicData staff member, or someone you are not. Misleading others about who is creating or sharing content is unacceptable.
  • Privacy Violations: It is prohibited to use the platform to publish or disclose private or personal information about someone else without their consent. This includes sensitive personal data, financial information, passwords or credentials, or any data that would violate privacy laws if shared. Always respect privacy and confidentiality when handling data on ClicData.

4.6 Unauthorized Commercial or External Use

  • Reselling and Sublicensing: You are not allowed to resell, lease, or sublicense the ClicData Service to third parties without our authorization. Your account is meant for your (or your organization’s) use only.
  • Outside the Intended Purpose: Any use of ClicData that is outside the scope of its intended functionality or your agreement with us is prohibited. You must use the platform only in the manner officially supported and documented by ClicData. For instance, do not use personal trial accounts for heavy production workloads, and do not use consumer modules in a way that circumvents enterprise licensing. If you are unsure if a use case is allowed, please seek clarification from ClicData.
  • Interference with Others: Do not engage in any activity that interferes with any other user’s ability to use and benefit from ClicData. This includes attempts to access or tamper with other users’ data, launching attacks or excessively heavy processes that degrade others’ experience, or using the Service in a way that unfairly monopolizes resources to the detriment of others.

4.7. Other Unacceptable Behaviors

  • Violation of Laws or Regulations: In addition to the examples above, any use of the Service that violates applicable local, state, federal, or international laws or regulations is strictly prohibited. This includes regulations on data export/import, sanctions, and any rules specific to your industry (e.g., financial regulations, healthcare data rules) if applicable.
  • Encouraging Violations: You may not solicit or encourage any activity that violates this AUP or ClicData’s Terms of Service. For example, you can’t help someone else to do something using our platform that would break these rules.
  • Catch-All: Any conduct that is malicious, irresponsible, or disruptive and not in the spirit of acceptable use, even if not explicitly listed here, may be deemed a violation at ClicData’s discretion. We reserve the right to determine what behavior is considered a violation of this AUP.

5. User Responsibilities

All users of ClicData have a responsibility to use the platform safely, ethically, and in compliance with this AUP. Key user responsibilities include:

  • Account Security: You must keep your account credentials confidential and secure. Do not share your password or API keys with unauthorized persons. Use strong passwords and enable multi-factor authentication (if available) to protect your account. You are responsible for all activities that occur under your login credentials. If you discover or suspect any unauthorized access to your account, you must notify ClicData immediately.
  • Accurate Information: When registering for or using the Service, provide truthful, current, and complete information. For example, you must use a valid email address and your correct identity. Creating fake accounts, using throwaway email addresses to evade limits, or misrepresenting your company information is not permitted. Keep your account information up to date.
  • Compliance with Laws and Standards: You are responsible for ensuring that your use of ClicData complies with all applicable laws and regulations, including data protection laws (like GDPR, CCPA, HIPAA if applicable) and export control laws. If your work involves personal data, you should obtain all necessary consents and legal bases before importing it into ClicData.
  • Do not use ClicData to process sensitive personal data (e.g. health or financial information) unless you have verified that doing so is in compliance with relevant laws and with ClicData’s capabilities/agreements (for instance, ensure a Data Processing Agreement is in place if required by GDPR).
  • Intellectual Property Ownership: Any content or data you upload to ClicData remains your property or the property of your licensors. It’s your responsibility to only upload content that you have the right to use. By using ClicData, you confirm that you have obtained any necessary permissions for the data and content you handle on the platform. If you’re using content that isn’t yours, make sure you have a license or consent from the owner.
  • Use Within Intended Scope: Use the Service only as intended and in accordance with any documentation or usage guidelines provided by ClicData. For example, adhere to any API usage limits and only use features for their intended purposes. If you are on a trial, respect the trial limitations. Enterprise features or modules should be used only if you have the appropriate subscription. Do not attempt to extend, copy, or provide the Service beyond what’s allowed (such as creating public-facing dashboards for resale if not permitted by your plan).
  • Respect for Others: If the platform allows you to communicate with others (e.g., sharing dashboards, sending invites or comments), you should be courteous and respectful. Ensure that communications are relevant and sent to intended, consenting recipients. Do not engage in harassment, spam, or send irrelevant or excessive communications to other users or third parties via ClicData. Treat ClicData staff and support personnel with respect when interacting with them; abusive language or behavior toward our team is not acceptable.
  • Protecting Platform Integrity: You should take care not to introduce risks to the platform. This means you should run up-to-date antivirus/anti-malware on devices you use with ClicData to avoid inadvertently uploading infected files. Do not intentionally or negligently upload files that could harm the Service or other users’ data.
  • Third-Party Users and Access: If you are an account owner or administrator, you are responsible for ensuring that all end users (e.g. your employees or contractors using your ClicData account or workspace) are aware of and comply with this AUP. Make sure to only grant access to trusted individuals. You will be held responsible for misuse of the Service by anyone operating under your account or on your behalf.
  • Reporting Issues: If you become aware of any violation of this AUP (by any user), or if you discover a security vulnerability or any other issue that could compromise the platform or other users, you should report it promptly. Contact ClicData support or use the designated reporting channels to inform us. We encourage responsible reporting and will review all genuine reports and take appropriate action. (See the Reporting Violations section below for details.)
  • No Minors: ClicData’s services are not intended for use by children. You must be at least 13 years old (or the minimum age required by local law if higher) to use ClicData. If you are using ClicData on behalf of an organization, you must ensure that all individual users meet this age requirement.

By following these responsibilities, you help us maintain a secure and trustworthy platform for everyone. Failure to uphold these responsibilities may lead to the enforcement actions described below.

6. Monitoring and Enforcement

ClicData takes violations of this AUP seriously. To preserve the integrity of our Service and protect our user community, we reserve the right to monitor and enforce compliance as follows:

  • Monitoring: ClicData may monitor your usage of the Service and your content to the extent permitted by law. While we respect your privacy and do not proactively view your data, we may investigate activity or content if we have reason to believe a violation of this AUP has occurred. We may also be alerted to violations through automated systems or third-party reports. (However, ClicData is not obligated to monitor all user content or activities, and you should not assume that we will.)
  • Investigation: ClicData reserves the right to investigate any potential breach of this AUP. This may include reviewing content, logs, and metadata related to your use of the Service. We may ask you for cooperation or additional information as part of an investigation. Your cooperation is expected in any enforcement investigation; failure to cooperate or providing false information could aggravate the situation.
  • Enforcement Actions: If we determine (in our reasonable judgment) that you have violated this AUP, we may take action at our discretion. Such actions may include:
    • Warning or Notice – For minor or first-time violations, we may issue you a warning and request corrective action.
    • Removal of Content – ClicData may remove or disable access to any content that violates this Policy (for example, deleting offending data or stopping a report distribution).
    • Suspension or Restriction – We may suspend your account or temporarily restrict certain functionalities (such as blocking your ability to share externally) if your use poses a risk or if you’re under investigation for a violation. Suspension can apply to the entire account or specific users under an organization’s account.
    • Throttling or Quotas – In cases of resource abuse, we may throttle your usage (e.g., limit API calls or data throughput) or impose new quotas to protect the service and other users. We will typically notify you if we do this.
    • Termination of Service – For serious or repeat violations, ClicData may terminate your account or subscription entirely. In especially egregious cases (for example, proven illegal activity, willful security breaches, or repeated misconduct), termination may be immediate and without prior notice. If your account is terminated due to AUP violations, you will not be entitled to a refund of any fees paid, and we may delete or disable access to your content.
    • Legal Action – If your violation of this AUP causes harm to us, our users, or third parties, or if it involves unlawful conduct, ClicData reserves the right to take legal action. This may include seeking civil damages and/or referring the matter to law enforcement. We will cooperate with law enforcement authorities as needed, including complying with lawful requests for information.
  • No Limit on Other Remedies: The enforcement actions listed above are not exhaustive. ClicData may take any other remedial action permitted under our Terms of Service and by law. Our choice not to enforce any particular provision of this AUP in one instance does not waive our right to enforce it in the future or in other instances.
  • Notification: When reasonable and lawful, ClicData will attempt to notify you of AUP violations and allow you an opportunity to respond or remedy the issue, especially for less severe issues. However, in cases where a violation is severe or time-sensitive (e.g., an ongoing security threat or illegal content), we may act immediately and without notice. Keep your contact information updated so we can reach you if needed.

7. Reporting Violations

We appreciate the assistance of our users in keeping the ClicData community safe and compliant. If you become aware of any suspected violation of this AUP by any user (including third parties), please report it to us as soon as possible. You can report violations by contacting the ClicData Support team or emailing contact@clicdata.com with the relevant details. Please provide as much information as you can to help us investigate (e.g. account name, description of the questionable activity or content, logs or screenshot if appropriate).

ClicData will review all reports of violations and will take appropriate action at our discretion. We may also report any illegal activities to the appropriate authorities. Your good-faith reports are appreciated, and we will keep your report confidential to the extent possible and allowed by law. (Note: Knowingly submitting false or misleading reports, however, is a violation of this Policy.)

If you have security concerns or have discovered a potential vulnerability in the platform, please report it in a responsible manner (e.g., privately to us) and do not disclose it publicly until we have had a chance to address it. Responsible disclosure helps protect everyone.

8. Policy Updates

ClicData may update or modify this Acceptable Use Policy from time to time as needed to adapt to changing laws, regulations, or operational requirements. When we make changes, we will post the revised AUP on our website and update the “Effective Date” at the top of the policy. In some cases, we may also notify users via email or through the Service of significant changes. Continued use of the ClicData platform after any modifications to this Policy constitutes your acceptance of the revised terms. We encourage you to review this AUP periodically to ensure you remain in compliance.

9. Contact and Acknowledgment

Thank you for reading and abiding by ClicData’s Acceptable Use Policy. These guidelines are in place to ensure a secure, reliable, and respectful environment for all users of the platform. By using ClicData, you acknowledge that you understand and agree to this AUP.
